1. Acceptance

By creating an account or using EchoJay ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EchoJay provides browser-based and plugin-based audio metering tools and AI-powered mix feedback. The Service includes free and paid subscription tiers, as well as one-time credit purchases.

3. Accounts

You must provide a valid email address and are responsible for maintaining the security of your account. You must be at least 13 years of age to use the Service. One person or entity may not maintain more than one free account.

4. Subscriptions and Payments

Paid plans (Pro, Studio) are billed monthly via Stripe. You can cancel at any time — access continues until the end of your billing period. Credit pack purchases are one-time and non-refundable. Prices are in USD and may change with 30 days notice.

5. Usage Limits

Each plan includes a daily AI message limit. Unused daily messages do not roll over. Purchased credits do not expire and are used automatically when daily limits are reached.

6. Audio Data

Audio metering and analysis happen locally in your browser or DAW plugin. For paid users who opt in, audio files may be stored on our servers for playback and cross-device access. Audio files are deleted if you cancel your subscription. We do not use your audio for AI training or share it with third parties.

7. AI Feedback

AI mix feedback is generated by third-party language models and is provided for informational purposes only. EchoJay does not guarantee the accuracy, completeness, or suitability of AI-generated advice. You are responsible for your own creative and technical decisions.

You retain full ownership of any audio you upload or analyse. EchoJay retains ownership of the Service, its software, and its branding. AI-generated feedback is provided for your use but does not constitute a work-for-hire or transfer of intellectual property.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. EchoJay is not liable for any damages arising from your use of the Service, including but not limited to lost data, lost profits, or decisions made based on AI feedback. Our total liability is limited to the amount you paid in the 12 months preceding any claim.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting support.

12. Changes

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance.
